Georgia mothers sued a sperm bank over alleged flawed sperm.
The donor to the sperm bank claimed to be a Ph.D. in neuroscience with an IQ of 160. The donor actually was a college dropout with a felony record and diagnosed with schizophrenia.
None of the children have developed mental illness yet, but the mothers sued because they fear that in time such disorders might develop.
The plaintiffs argued to the court that had they known the truth about the donor, they never would have used his sperm and, thus, their children would have never been born.
The judge dismissed the wrongful birth claims. The Federal Judge stated “Wrongful birth claims are disfavored because they require the court to decide between the value of a life with disabilities and the value of no life at all.”
